1. Applicability

These terms and conditions apply to the use of the Sportspeler app and the services offered within it. By using the app, you agree to these general terms and conditions and our privacy policy.

2. Services

Sportspeler facilitates the finding of teammates, substitutes, and matches. The app aims to create a platform for players to organize and participate in matches. If locations are missing in the app, athletes or locations of sports venues can request an additional location to be added to the app via email.

3. Account Creation

Users must create an account by providing their first name, last name, email address, skill level, and clubs, as well as uploading a profile picture. The use of the app is intended for individuals aged 16 and older. If you are under 16, you must have permission from a parent or guardian. An account is meant for consumers; it is not allowed to create an account as an organization or company or use the app for commercial purposes.

4. Use of the App

Users can create and search for matches. The app is currently only available in the Netherlands. Court reservations must be made through the respective club. Sportspeler will always try to prevent network interruptions and unavailability of services, but is not responsible and cannot be held liable for any form of network interruption and unavailability of the services.

5. Costs

The app is free to use. Future premium features may become available but are not mandatory.

6. Cancellation

Users can cancel up to 2 hours before the scheduled match. If a user wishes to cancel within this period, it is desirable that they find a replacement themselves and contact the organizer of the match. If necessary, the organizer can remove a participant from the match.

No-shows or people who cancel within the two-hour period can be reported by email. The email address can be found through the contact option on the settings page in the app or on the website.

7. Liability

Sportspeler is not liable for any form of damage, loss, or costs arising from the use of the app, including the inability to find teammates, cancellations, or players not showing up on time for matches. Sportspeler is also not liable for injuries or accidents that occur during matches. Any damage claims are excluded.

8. User Obligations

Users are required to show respectful behavior towards other users. They may not share inappropriate, illegal, or copyrighted content or spam and must take responsibility for the information they share. Penalties or fines may be imposed for violating these obligations. Sportspeler reserves the right to take appropriate measures, including blocking or deleting the account.

9. Intellectual Property Rights

All content in the app, including texts, images, and logos, is protected by copyright and other intellectual property rights. Users do not acquire any rights to this content by using the app.

10. Compensation

Users are responsible for any damage resulting from their actions in the app, including damage to third parties from agreements they make, misuse of the platform such as the use of false information, and unlawful behavior such as intimidation or discrimination.

11. Data Protection

Personal data is securely stored and processed in accordance with the General Data Protection Regulation (GDPR). The email address is not shared with other users. For more details, see our privacy policy. We ensure data security.

12. Termination of Services and Accounts

Sportspeler reserves the right to take a user offline and/or block them at any time, for example, in case of violation of these general terms and conditions or misuse of the app.

13. Applicable Law and Dispute Resolution

These terms are governed by Dutch law. In case of disputes arising from or related to these general terms and conditions, the parties will attempt to resolve them amicably. If this is not possible, disputes will be submitted to the competent court in the Netherlands.

14. Penalties for Violations by Organizations or Companies

In case of violation of these terms by organizations or companies, such as creating an account or using the app for commercial purposes or other recruitment or advertising activities, an immediately payable and non-reducible fine of €1,000.00 (in words: one thousand euros) will be due to Sportspeler for each violation, plus €200.00 (in words: two hundred euros) for each user approached or participation in a match.

15. Changes to the General Terms and Conditions

Sportspeler may change these general terms and conditions from time to time. The most recent version is always available via the app and the website. Users can review the general terms and conditions at any time and do not need to agree again. By continuing to use the app after changes, you agree to the new terms.
